Sri Suneel Kumar Chaoudhary has filed this civil writ petition with the prayer that writ in the nature of mandamus be issued directing the respondents to issue formal letter of appointment in view of selection of the petitioner on the post of Fitter to serve Bharat Heavy Electricals Limited.

Learned counsel has drawn the attention of the court towards Annexure 5 to say that the petitioner was selected as one of the persons amongst twenty-four. Attention of the court has also been drawn towards Annexure 6 (Serial No.62), according to which the petitioner was asked to report for medical examination. Learned counsel contends that although the petitioner has been medically examined, letter of appointment or posting has not been issued to him and no reason has been assigned to him as to under what circumstances he has been denied appointment and posting, even though persons junior to him in merit as per the select list, have been given appointment and posting orders.

Issue notice to respondents.

At this stage Sri Ram Sakal Mishra, Advocate, has put in appearance for Union of India, respondent no.1. He has filed his Vakalatnama, which is taken on record.

Let the name of Sri Ram Sakal Mishra, Advocate, be reflected in the cause list.

Let respondent nos.2 and 3 be served by way of registered A.D. Post also, returnable in three weeks.

In case, the twenty-fourth post is filled up by the respondents, it shall remain subject to result of this writ petition.
