Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

Learned counsel for the applicant submitted that there is no direct evidence of murder and the case is based on circumstantial evidence. Identically placed co-accused Smt. Bacho and Ram Kumar have been granted bail by orders dated 11.1.2012 and 8.5.2012 passed by different Benches of this Court in criminal misc. bail applications no.417 of 2012 and 28944 of 2011.

Learned A.G.A. opposed the prayer for bail.

Since identically placed co-accused have alredy been granted bail, there are sufficient grounds to enlarge the applicant on bail.

Let applicant Gorey Lal involved in case crime no.296 of 2011 under Sections 302, 201 I.P.C. pertaining to Police Station Mauiama, District Allahabad be released on bail on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the Court concerned with the following conditions :

(a) The applicant shall attend the court according to the conditions of the bond executed by him ; and

(b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
