The petitioner is a Safai Karmi. He was posted at Kukursanda Vikas Khand Sathiaon, District Azamgarh. By the order dated 21.5.2012 he has been transferred from Gram Panchayat Surahan to Vikas Khand Martinganj. The petitioner joined at Martinganj. By the order dated 20.7.2012, the transfer order dated 21.5.2012 has been cancelled and the petitioner has been asked to be posted at Gram Panchyat Kukursanda. By the letter dated 23.7.2012 Sahayak Vikas Adhikari Panchayat, Martinganj has directed the petitioner to join at Kukursanda.

The contention of the petitioner is that he has joined at Gram Panchayat Kukursanda. Now the petitioner received an order dated 21.7.2012 by which the petitioner has been transferred to Gram Panchayat Kharihani Vikas Khand Mehanagar which is being challenged in the present writ petition. The contention of the petitioner is that the transfer has been made at the behest of the Minister.

Prima facie, it appears that the frequent transfer is without any basis.

Let the Standing Counsel may file counter affidavit within four weeks. Rejoinder affidavit may be filed within two weeks.

List thereafter before the appropriate Bench.

Until further order, the operation of the transfer order dated 21.7.2012 Annexure-4 to the writ petition shall remain stayed.
