Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
Learned counsel for the applicant submitted that role of catching hold has been assigned to the applicant, whereas role of causing gunshot injuries to the deceased has been attributed to co-accused Rajnesh @ Badey Lalla.
Learned A.G.A. opposed the prayer for bail.
Considering all the facts and circumstances, the case of the applicant is distinguishable from co-accused Rajnesh @ Badey Lalla, who is said to have caused gunshot injury to the deceased, and the applicant may be enlarged on bail.
Let applicant Latoori Singh alias Phauji involved in case crime no.46 of 2012 under Sections 302, 504, 506 I.P.C. and Section 3 (2) (v) S.C./S.T. Act pertaining to Police Station Allaganj, District Shahjahanpur be released on bail on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the Court concerned with the following conditions :
(a) The applicant shall attend the court according to the conditions of the bond executed by him ; and
(b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
