This petition prays for issuance of a writ in the nature of certiorari quashing order dated 14.6.2012, Annexure-1, vide which recovery proceedings have been initiated against the petitioner in consequence of enquiry report dated 12.8.2010, Annexure-3.

Learned counsel for the parties have pointed out that a recommendation has been made for removal of the petitioner by Block Development Officer vide order dated 06.6.2012, which has been challenged under Civil Writ Petition No.3375(SS) of 2012, Jitendra Kumar Vishwakarma v. Union of India.  The said writ petition has been disposed of while giving liberty to the District Magistrate to take appropriate action in accordance with law within a period of two months from the date of receipt of certified copy of this order.

In view of order passed in Civil Writ Petition No.3375(SS) of 2012, Jitendra Kumar Vishwakarma v. Union of India, this petition is also disposed of with liberty to the District Magistrate, Ambedkar Nagar, to take a decision, as regards recovery from the petitioner within a period of two months from the date of receipt of certified copy of this order.  Till the decision is taken, recovery proceedings shall be held in abeyance.

With the above observation, the petition is disposed of.
