HIGH COURT OF JUDICATURE AT ALLAHABAD

?Court No. - 39

Case :- WRIT - A No. - 48301 of 2011

Respondent :- State Of U.P. And Others

Petitioner Counsel :- Shri Nath Dwivedi

Hon'ble Rajes Kumar,J.

The claim of the petitioner is that he has been appointed in the Civil Police and he has worked for more than 10 years and, therefore, he cannot be transferred to Armed Police.

On 24.8.2011, learned Standing Counsel was directed to seek instruction in the matter. On 30.8.2011, learned Standing Counsel stated that the petitioner has been appointed as an Armed Police and not as Civil Police and, therefore, he has been sent back to his original cadre i.e. Armed Police.

On the submission of learned Standing Counsel, the petitioner has been asked to file an appointment letter. Supplementary affidavit filed today but the appointment letter has not been filed.

Learned counsel for the petitioner states that he is not able to get the appointment letter, therefore, he could not file the same. He further submitted that he wants to withdraw the writ petition.

In view of the above, the writ petition is dismissed as withdrawn.
