Heard learned counsel for the applicant and learned A.G.A.

This application has been filed with a prayer to quash the order dated 2.9.2011 passed by learned Special C.J.M. (Customs) Lucknow in case No. 2873 of 2006  whereby the N.B.W. has been issued against the applicant.

From the perusal of the record it appears that due to non appearance of  the applicant the N.B.W. has been issued. There is no illegality in issuing the N.B.W. , therefore, the prayer for quashing the N.B.W. is refused..

Considering the submission made by learned counsel for the applicant, it is directed that applicant shall appear before the court concerned within 30 days from today, till then the N.B.W. issued against the applicant shall be kept in abeyance, thereafter in case the applicant appears and applies for bail before the court concerned, the same shall be heard and disposed of Smt. Amrawati and another Vs. State of U.P. 2005 Cr.L.J. 755.

With this direction, this application is finally disposed of.
