The petitioner is challenging a show cause notice dated 5.9.2011 issued by the Deputy Inspector General of Police/Senior Superintendent of Police, Kanpur Nagar based on the inquiry report, which has been challenged in Writ Petition No. 56812 of 2011, which is pending for consideration.

The aforesaid writ petition has been entertained and an interim order has also been passed. Therefore, the Court is of the view that since the inquiry report, which is subject matter of consideration in the aforesaid writ petition, and the show cause notice has been issued on the basis of the said inquiry report, the show cause notice is also liable to be stayed.

Let the learned Standing Counsel may file counter affidavit within four weeks. Rejoinder affidavit may be filed within two weeks thereafter.
