Heard learned counsel for the applicants and learned A.G.A.

This application has been filed with a prayer that  delay in filing the re-hearing application may be condoned and an opportunity of being heard may be afforded to the applicants.

From the perusal of the record it appears that in the present case the order dated 19.9.2006 has been passed by Hon. Alok Kumar Singh, J. after considering the merits of the case. The review/recall is not permissible under the law. Therefore, there is no good ground to permit the counsel for the applicant for re-hearing. In such circumstances, it is not proper to contoned the delay in filing such application. The prayer for condoning the delay in filing the re-hearing applicant is refused.

Accordingly this application is dismissed.
