Heard learned counsel for the applicants and learned A.G.A.
This application has been filed with a prayer to quash the order dated 28.3.2005 in criminal case No. 1827 of 2005 arising out of charge sheeet submitted in case crime No. 197 of 2004 under sections 420, 467, 468, 447, 323, 504, 506, 379 IPC, P.S. Krishna Nagar, Lucknow pending in the court of learned Special C.J.M. (Customs), Lucknow.
From the perual of the record it appears that the allegation made against the applicant prima facie disclosing the officen. There is no illegality in submission of the chargesheet and in taking the cognizance. There is no good ground for quashing the summoning order, prayer for quashing the same is refused.
However, it is directed that in case the charge has not been framed and applicant move discharge application within 30 days from today before the court concerned through this counsel, the same shall be heard and disposed of under the provisions of law. Till the disposal of that application, the applicants shall not be arrested.
With this direction, this application is finally disposed of.
