This application has been filed with a prayer to quash the further proceedings of case No.  35 of 2007  arsing out of charge sheet submitted in case crime No. 163  of 1998 P.S. Swaroop Nagar, District Kanpur Nagar under section 409, 467, 468, 471, 420, 218, 120-B IPC read with section 13(1)(c), 13(1)(d) and 13(2) Prevention of Corruption Act, 1988. 

From the perusal of that record it appears on the basis of the allegation made in FIR as well as the material collected by the I.O. prima facie aforesaid offence is made out. There is no illegality in submission of the chargesheet and in taking the cognizance. The prayer for quashing the proceedings of the above mentioned case is refused.

The interim order dated 4.7.2008 are is hereby vacated.

Office is directed to communicate a copy of this order to learned Special Judge (Prevention of Corruption Act), Lucknow forthwith so that the proceedings of the trial may be expedited.

With this direction, this application is finally disposed of.
