In terms of the order dated 29.9.2011, the Principal was asked to file his affidavit indicating as to on what basis he has issued the marks certificate in favour of the petitioner dated 20.12.2003 when admittedly on the basis of the record submitted by the Board petitioner had not qualified the examination.

In compliance to the order dated 29.9.2011, the principal has filed his affidavit today in Court, which is taken on record.

In the affidavit, the Principal has stated that the the Head Clerk, Sri Krishna Lal Srivastava, received corrected mark-sheet from the Board in his hand writing and on that basis effected corrections in the cross list submitted by the Board. It is stated by the Principal that he has put his counter signature only on the corrected cross list.

An affidavit of Sri Krishna Lal Srivastava, Head Clerk, stated to have retired, is required to indicate as to on what basis he has effected the corrections in the cross list. He is required to produce the correct mark-sheet issued by the Board on the basis of which corrections have been effected.

Let an affidavit be filed by Sri Krishna Lal Srivastava, Head Clerk, on or before 12.11.2011. He is directed to remain present in the Court on the next date.

Notice shall be sent to Sri Krishna Lal Srivastava, R/o Village-Khutha, Post-Ghanti, Police Station-Bhatni District Deoria through S.H.O. Bhatni, District Deoria within two days. Principal is also directed to appear in the Court on the said date.

List this matter on 3.11.2011.
