Learned counsel for the petitioner submitted that for the appointment of Gram Rozgar Sewak, an advertisement was issued on 10.5.2011 and in pursuance thereof the petitioner applied for the said post. At that time, only two applications have been filed. However, further proceeding has not been taken despite the direction issued by the District Magistrate, Kanshiram Nagar. Therefore, the petitioner approached this Court by way of Writ Petition No. 58225 of 2011 wherein a direction has been issued to decide the representation of the petitioner. In pursuance thereof, the District Development Officer, Kanshiram Nagar vide letter dated 3.11.2011 wrote an impugned order to Khand Vikas Adhikari, Kanshiram Nagar asking him to issue a fresh advertisement and invite fresh applications, which is wholly unjustified. He submitted that the Gram Pradhan is interested in appointing his own man, therefore, he has not proceeded to appoint Gram Rozgar Sewak in pursuance of the earlier advertisement.

Sri Ajit Kumar, Advocate, holding brief of Sri D.D. Chauhan, Advocate appears on behalf of respondent no. 5 and learned Standing Counsel appears on behalf of respondents no. 1 to 4.

The respondents may seek instruction in the matter.
