The petitioner applied for the post of Gram Rozgar Sewak in pursuance of the advertisement dated 1.2.2011. The advertisement dated 1.2.2011 is Annexure-2 to the writ petition. In the said advertisement, it was specifically stated that the reversation policy will be applied on the basis of the present Pradhan post. The petitioner applied for Gram Panchayat Lamaura. Now a fresh advertisement has been issued on 12.10.2011 in respect of the same Gram Panchayat for the appointment of Gram Rozgar Sewak wherein it is stated that the reservation will be applicable on the basis of the Ex-Pradhan of 2005. The petitioner is challenging the advertisement dated 12.10.2011 on the ground that in the current appointment on the post of Gram Rozgar Sewak the reservation on the basis of the Ex-Pradhan of 2005 cannot be applied.

The submission of the learned counsel for the petitioner has substance and requires consideration.

Sri Anuj Kumar, Advocate appears on behalf of respondent no. 4. Learned Standing Counsel appears on behalf of respondent nos. 1 to 3. All the respondents may file counter affidavit within four weeks. Rejoinder affidavit may be filed within two weeks thereafter.

List thereafter.

Till the next date of listing, the operation of the advertisement dated 12.10.2011 issued by respondent no. 2, Annexure-4 to the writ petition, shall remain stayed.
