Prayer for bail has been made on behalf of the appellants, who have been convicted by Additional Sessions Judge, Court No.8, Firozabad in S.T. No.182 of 2005 under Sections 307/34, 504, 506 I.P.C.
Heard learned counsel for the appellants and the learned A.G. A. for the State and perused the lower court's record.
Learned counsel for the appellant submitted that maximum sentence awarded to the appellant is six years. It is further submitted that appellants are languishing in jail.
Learned A.G.A opposed the prayer for bail.
Considering the facts and circumstances of the case, in my opinion the appellants are entitled to be released on bail.
Pending appeal appellants Netra Pal and Anoop are convicted in S.T. No. 182 of 2005 shall be released on bail on their executing a personal bond and on furnishing two sureties each in the like amount to the satisfaction of the court concerned.
Till further orders realization of fine, if any, shall also remain stayed.
