Prayer for bail has been made on behalf of the appellants, who have been convicted by Additional Sessions Judge, Court No. 3, Lakhimpur Kheri in S.T. No. 288/01, under Section 304 (2) I.P.C .P. S. Maigalganj, District Kheri.
Heard learned counsel for the appellants and the learned A. G. A. for the State and perused the lower court's record.
Learned counsel for the appellants submitted that maximum sentence awarded to the appellants is seven years. The appellants were on bail during the trial.
Learned A. G. A. opposed the prayer for bail of the appellant.
Considering the facts and circumstances of the case in my opinion appellant is entitled to be released on bail.
Pending appeal appellants Rakesh & Rajendra convicted in S. T. No. 288/01, under Section 304 (2) I.P.C .P. S. Maigalganj, District Kheri, shall be released on bail on their executing a personal bonds and on furnishing two sureties each in the like amount to the satisfaction of the court concerned.
Till further orders realization of fine, if any, shall also remain stayed.
