Admittedly the petitioners have been admitted in the B.Ed. Courses without counselling. Those students, who have been admitted in the colleges without counselling, the Full Bench of this Court has declared such admission as illegal. The students filed several Special Leave to Appeals (C) No. 12864 of 2008 and others before the Hon'ble Supreme Court. It appears that the State of U.P. has filed affidavit before the Hon'ble Supreme Court stating therein that the students admitted in 2005-06 of Purvanchal Vishwavidyalaya and in 2006-07 of Agra and Meerut Universities their result will be declared and accordingly applications have been moved by some of the students of those Universities to withdraw the Special Leave to Appeals. The appeals were permitted to be withdrawn by the order dated 23.2.2009.

Learned counsel for the petitioners submitted that various colleges affiliated with the other Universities also stood on same footing and, therefore, in respect of some of the colleges affiliated with other Universities, a direction has been issued by the Division Bench of the Lucknow High Court for the declaration of the result. The petitioners are the students of respondent no. 5 affiliated with Chhatrapati Sahu Ji Maharaj University, Kanpur, therefore, in the case of the petitioners also a direction may be issued to the University to declare the result and to provide the mark-sheet.

The University is represented by Sri Neeraj Tiwari, Advocate. Let he may seek instruction in the matter. Learned Standing Counsel may also seek instruction that what is the stand of the State Government.

Put up on Thursday i.e. on 15.12.2011 as fresh.
