Connect with Writ Petition Nos. 30860 of 2007, 35908 of 2007, 56857 of 2008, 6748 of 2011 and 33661 of 2011.

The petitioners are challenging the order dated 23.11.2011 passed by the Regional Level Committee by which the election held on 21.8.2011 as well as election dated 17.7.2011 claimed by the rival Committee of Management have been set aside and a direction has been issued for fresh election.

Learned counsel for the petitioners submitted that the impugned order is patently illegal.

Sri Prabhakar Awasthi, Advocate appears on behalf of respondent no. 9. Leaned Standing Counsel appears on behalf of respondents no. 1 to 5. Sri P.K. Mishra, Advocate appears on behalf of respondent no. 8. Issue notice to respondent nos. 6 and 7. The petitioners may serve the respondent nos. 6 and 7 by dasti summon as well as by registered post. All the respondents may file counter affidavit within two weeks. Rejoinder affidavit may be filed within one week.

List in second week of January, 2012.

Till the next date of listing, there shall be no fresh election in pursuance of the impugned order dated 23.11.2011 passed by the Regional Level Committee.
