The petitioners claim that their services are more than 10 years in the Civil Police and, therefore, in view of the Regulation 525 of the Police Regulation, they cannot be transferred to the Armed Police. Reliance is placed on Regulation 525 and also on the decision of the Supreme Court in the case of Jasveer Singh vs. State of U.P. and others, reported in 2008(2) ADJ 484(SC), wherein on consideration of Regulation 525, it has been held that the Police Constable working in the Civil Police Force since more than ten years cannot be transferred to the Armed Police Force or vice versa.
Learned Standing Counsel prays for and is granted four weeks' time to file the counter affidavit. Rejoinder affidavit may be filed within two weeks' thereafter.
List thereafter.
Till the next date of listing, operation of the transfer order dated 13.8. 2011, Annexure-1 to the writ petition, shall remain stayed.
