    Perused the office report dated 30.7.2011 in regard to service of notices issued to the respondent nos. 1 to 5 by Registered Post A.D.

    As per the said office report, respondent nos. 1, 2 and 4 are represented through their respective counsel.

    As regards respondent no.3, the office report states "Neither undelivered cover nor acknowledgement have been received back after service".

    In view of the said office report, service of notice on the respondent no.3 is deemed to be sufficient in view of the provisions contained in Explanation II to Rule 12 of Chapter VIII of the Rules of the Court.

    As regards respondent no.5, the office report states "undelivered cover returned with P.O. report gone out"

    In view of the said office report, let fresh notice be issued to the respondent no.5 by Registered Post A.D. fixing the next date fixed in the matter.

    Requisite steps will be taken within three weeks.
