Heard learned counsel for the parties and perused the record.

The learned counsel for the petitioner submitted that the petitioner has retired on March 2009 but he has not been paid his post retiral benefits. 

Accordingly, we dispose of the writ petition directing the Principal Secretary, Department of Urban Development, Civil Secretariat, Bapu Bhawan, Lucknow to look into the matter and take an appropriate decision with regard to payment of post retiral benefit of the petitioner in accordance with law by passing a speaking and reasoned order, expeditiously and preferably, say within a period of two months from the date of receipt of a certified copy of this order.

While deciding the controversy with regard to the post retiral benefits of the petitioner, the Principal Secretary shall also take a decision with regard to interest on account of delayed payment of post retiral benefits.

Liberty is given to the petitioner to represent his case afresh.
