Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This Crl. Misc. application under Section 482 Cr.P.C. has been filed for a direction to the court below to dispose of the bail application of the applicant expeditiously, preferably on the same day in case crime no. 62 of 2011, under sections 3/5/8/k of Prevention of Cow Slaughter Act and Section 307 IPC, P.S. Station -Bhadohi, district Sant Ravidas Nagar ( Bhadohi).
Learned counsel for the applicant contented that the applicant was not present at the spot. There was allegation that co-accused was driver of the truck by which three animals were being transported. On being asked by the police to stop, he tried to crush the police party. The allegation was that the animals were being transported for slaughtering. The applicant has nothing to do with the animals. Neither he was driving the truck nor he tried to crush the police party as alleged in the FIR.
In view of the aforesaid facts, if the applicant appears before the court concerned within three weeks from today and apply for bail, it is expected that the same shall be considered and disposed off as expeditious as possible, preferably on the same day.
With these observations, application filed under Section 482 Cr.P.C. is disposed off finally.
