In response to Phonographic Performance Limited's lawsuit alleging copyright infringement by Sandoz and Gola Sizzlers, the Delhi High Court has temporarily barred the two eateries from playing the sound recordings of the latter company.

A complaint has been filed against the two restaurants asking for the granting of an ex-parte ad-interim injunction, noted Justice C. Hari Shankar.

The declaration issued by Tim Hortons' legal representative that the restaurant would not play any of the sound recordings that are a part of Phonographic Performance Limited's repertoire without a licence also obliged the court.

The three restaurants were the target of copyright infringement lawsuits brought by Phonographic Performance Limited, a performance rights organisation, which claimed the restaurants were playing their sound recordings without a licence.

The organisation said it possesses and manages the rights to radio transmission and public performance for more than 400 record labels, along with more than 45 lakh sound recordings domestically and internationally.

In all three cases, the court issued summonses, and the next hearing was scheduled for February 7th, 2024.

On directives, the Tim Hortons attorney stated that the restaurant is not playing any sound recordings that are a part of PPL's repertoire and never plans to.

The court said that the facts in the objection justified granting such relief while issuing an interim injunction order against Sandoz and Gola Sizzlers. "No prejudice would ensue to the defendants, were ex parte interim orders to be passed to the said effect, as the plaintiff is merely seeking an injunction against the defendants from playing recordings in which the plaintiff has copyright and which form part of its repertoire, and the present ad interim order would only extend to such recordings," the court stated.
