The Union govt may soon introduce a separate legislation to deal with cyber crime. The move aims to make it tougher for offenders to get bail in such cases as per Maharashtra-based advocate Pankaj Bafna, who is a member of the drafting committee.

“The Union home ministry will come up with a new amendment under the Information Technology Act while the govt of Maharashtra had proposed a new cyber crime bill itself. The IT Act will then be used to take care of mostly civil cases, while the criminal ones will be dealt under the proposed cyber crime bill. Prosecution will be done for cyber crime cases like Indian Penal Code (IPC) cases,” said Bafna.

On the sidelines of the Global Cyber Security Conference here on Wednesday, Bafna said the cyber crime bill is still in the drafting stage & may be put up before the Parliament by Dec. or Jan.

“The proposed bill will solve the problem of jurisdiction for the police department as many cyber crime offenders are from other states or even abroad,” the lawyer said.

Speaking on the proposal, advocate Prashant Jhala, co-founder of Indian Cyber Lawyers & Indian Cyber Institute, said that the move aims to make punishments more rigorous for cyber crime offenders.

“Recently, it was reported that nearly Rs 7,800 crore was siphoned off in 2018-19 through cyber crime offences. The current IT Act is very weak & police have to add additional Indian Penal Code sections to the cyber crime offences to make the case strong. Almost all sections of the (current) IT Act are bailable,” Jhala said.

Experts are also of the opinion that several cyber crime cases can be attributed to the mistakes of the victim. “Cyber crime can occur due to the mistake of a user, in cases like card frauds, fake lotteries, phishing calls & similar frauds,” said co-founder of Indian Cyber Institute, Rizwan Shaikh.
