The Division Bench of the Karnataka High Court comprising Chief Justice Ritu Raj Awasthi and Justice S. R. Krishna Kumar in the case of Mohamed Ikbal v. Ministry of Rural Development and Ors has ordered the Respondents to implement the policy of providing free houses to weaker section of society belonging to BPL/EWS category.

Submission of the Petitioner

The counsel appearing for the petitioner has submitted that Court should order the Respondents to provide housing to eligible siteless/houseless urban and rural BPL/EWS families belonging to various categories of weaker section of the society within a period of 1 or 2 years based on the seniority list and pass any such order in the interest of siteless/houseless urban and rural BPL/EWS families in Karnataka.

Submission of the Respondent

The learned Advocate General appearing for the State has submitted that under the various schemes, whosoever, who is eligible and fulfills the criteria prescribed, applies has been benefited and has been given houses.

Reasoning and Judgment of the Court

The Court considered the facts of the case and expounded that the Court do not find any necessity to issue any direction to the respondents to provide the houses to the BPL/EWS persons for the urban or rural area.

The Court instructed the Respondent that Central Government as well as the State Government shall be properly implemented and the respondents shall ensure that the benefits under the said scheme reach the beneficiaries.

Therefore the Court disposed of the petition without imposing any cost on it.
