The Division Bench of the Manipur High Court, comprising Justice Ahanthem Bimol Singh and Justice A. Guneshwar Sharma in the case of Khumanthem Devabrata Singh Vs State of Manipur & 5 ors. has granted a two-week period for the state government to file a detailed affidavit indicating lapses on the part of the security forces with regard to their failure to ensure the protection and safeguarding those houses and properties.
Submission of the Petitioner
The Counsel appearing on the behalf of the Petitioner submitted that after passing of the two interim orders by this Court directing the respondents to provide adequate security at the Moreh for safeguarding the abandoned houses and properties of the displaced people, there has been two instances of burning down of about twenty empty houses and looting of properties belonging to the displaced people.

The Counsel appearing on the behalf of the respondent seeks two weeks time to allow the State authorities to file detailed affidavit regarding the steps taken with regard to burning down of the houses and looting the properties of the displaced people in the Moreh town as well as the lapses on the part of the security forces with regard to their failure to ensure the protection and safeguarding those houses and properties.
Reasoning and Decision of the Court
The Court perused the material available on record and heard both the parties and granted the prayer seeked by the respondents counsel for filling affidavit indicating the steps taken with regard to burning down of the houses and looting the properties of the displaced people in the Moreh town as well as the lapses on the part of the security forces with regard to their failure to ensure the protection and safeguarding those houses and properties.
The Court listed the matter on 31/08/23 for next hearing.
