The Single Judge Bench of the Allahabad High Court, comprising Justice Ajay Bhanot has granted anticipatory bail to the accused of making video using abusive language against Yogi Adidtyanath, the Chief Minister of Uttar Pradesh and sharing it over social media apps.
Submission of the Petitioner
The Counsel appearing on the behalf of the petitioner has submitted that the applicant did not have any intent of insulting high constitutional dignitaries and was induced into drinking by the co-accused persons and may have blurted out some objectionable words under the influence of liquor.
Reasoning and Decision of the Court
The Court heard the arguments of both the parties and granted bail to the applicant on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court below. The following conditions be imposed in the interest of justice:-
- The applicant will not tamper with the evidence or influence any witness during the trial.
- The applicant will appear before the trial court on the date fixed, unless personal presence is exempted.
