The Division Bench of the Bombay High Court, comprising Chief Justice Dipankar Datta and Justice MS Karnik in the case of Nitin Dalvi & Anr. v. State of Maharashtra & Ors. has granted two weeks time to the State Government to file affidavit in a PIL regarding vacancies in Maharashtra State Commission for Protection of Child Rights (SCPCR).

Background of the Case

The Petitioner has filed a Public Interest Litigation (PIL) by raising the grievance that the Maharashtra State Commission for Protection of Child Rights, constituted under the Commission for Protection of Child Rights Act, 2005, is non-functional due to absence of requisite number of members.

Reasoning and Decision of the Court

The Learned AGP appearing for the State Government has informed the Court that process has been initiated in the right earnest to fill up the posts. She also prayed for 2 weeks time to file a reply affidavit to bring on record the steps that have been taken and are contemplated to be taken for appointment of members.

The Court granted the AGP prayer and allowed her to file reply affidavit in two weeks.
