Rajasthan District Boards (Co-Opted Members) Rules, 1958

In exercise of the powers conferred by sub-section (2) of section 176 read with sub-section (1) of section 7 of the Rajasthan District Boards Act, 1954 (Rajasthan Act No. II of 1954) and after previous publication, the State Government does hereby make the following rules, namely:-

  1. Short title and Commencement.- (a) These rules may be called the Rajasthan District Boards (Co-opted Members) Rules, 1958.

(b) They shall come into force immediately.

  1. Supersession.- These rules supersede the rules made by notification No. F. 1/ 1 /61 /LSG/56, dated the 28th June, 1956.
  2. Definition.- In these rules-

(a) "Act" means the Rajasthan District Boards Act, 1954;

(b) "Reserved class" means women, scheduled castes or scheduled tribes; and

(c) "Reserve seats" means the membership reserved for women, scheduled castes or scheduled tribes under sub-section (2) of section 7 of the Act.

  1. Determination of number of seats.- Soon after assumption of Office, the Chairman of the Board shall call a meeting of the Board in which the number of co-opted members shall be determined in accordance with section 7 of the Act and a date not earlier than a week, for holding the next meeting of the Board for selection of such members shall be fixed.
  2. Preparation of a list of candidates.- Every elected member of the Board shall have a right send, in writing any number of names of candidates three days before such meeting, to the Chairman who shall prepare a list of such proposed names and may also include in such list any other person whom he considers suitable in view of his experience in the field of Local Self Government or otherwise. Such list shall be circulated to the elected member before such meeting is held.
  3. Selection by means of a majority vote.- At the meeting called for selection of co-opted members, if the number of such candidates is equal to the number required to be co-opted the Chairman shall declare them co-opted, otherwise the various names of the candidates in the said list shall be put to vote which shall be indicated by raising of hands and the votes obtained shall be recorded in each case and arranged in a descending order accordingly as the number of votes are polled by the candidates. Out of these, such first names as are equalled to the number required shall, by the Chairman, be declared co-opted provided that if such names do not contain the requisite number of members of the reserved class, the last of such candidates as are equal to the number by which the reserved seats fall short, shall be eliminated and in their place such of the remaining candidates as belong to the reserved classes and have received the largest number of votes shall be co-opted against the reserved seats till such seats have been filled in. In case where there is a tie between candidates who receive equal number of votes, elimination if necessary, shall be made by means of drawing lots.
  4. Publication of names and oath of office.- The names of the co-opted members selected in the manner as aforesaid shall be published in the Official Gazette and they shall, before entering upon their office, be required to take an oath of office or solemn affirmation in case of conscientious objectors to oath taking.
