The Punjab Water Supply and Sewerage Board (Conditions of Service of Directors) Rules, 1980

No. G.S.R. 37/P.A. 28/26/76/Section 71/80. - Dated 24th March, 1980. - With reference to Government of Punjab Department of Local Government, Housing and Urban Development notification No. G.S.R. 68/P.A. 28/76/S. 71/79, dated the 18th May, 1979 and in exercise of the Powers conferred by clauses (b) and (c) of sub-section (2) of Section 71 of the Punjab Water Supply and Sewerage Board Act, 1976 (Punjab Act No. 28 of 1976), the President of India is pleased to make the following rules, namely :-
- Short title and commencement.- (1) These Rules may be called the Punjab Water Supply and Sewerage Board (Conditions of Service of Directors) Rules, 1980.
(2) They shall come into force at once.
- Definitions.- In these Rules, unless there is anything repugnant in the subject or context, -
(a) 'Act' means the Punjab Water Supply and Sewerage Board Act, 1976;
(b) 'Associate Director' means a person co-opted by the Board as an Associate Director under sub-section (2) of Section 4 of the Act;
(c) 'Managing Director' means a person appointed as Managing Director of the Board.
- Qualifications.- (1) No person shall be appointed as Chairman unless he, -
[(i) has worked as Class I officer under the Government for a minimum period of five years]; or
(ii) possesses experience in providing civic and other utility services to the public in planning and execution of water supply and sewerage works or in managing the affairs of a corporate body owned or controlled by the Government for a minimum period of ten years; or
(iii) possesses at least five years experience of public life.
(2) No person shall be considered fit for co-option as Associate Director, unless he,-
(a) has worked for not less than ten years as Municipal Commissioner; or
(b) has worked for not less than five years as President of a Municipal Committee; or
(c) has worked for not less than three years as Chairman of an Improvement Trust; or
(d) has worked for not less than five years not below the rank of Regional or Zonal Manager in the Nationalized Bank, a scheduled bank or any other Central or State Financial institution; or
(e) has worked for not less than five years not below the rank of a Superintending Engineer in the Department of Public Works (Health Branch).
- Term of office.- [Section 5(1)] - The term of office of the Directors including the Associate Directors shall be one year :
Provided that the Government may extend the aforesaid terms from the year to year :
Provided further that a Director or an Associate Director shall cease to hold office on attaining the age of 58 years :
Provided further that the Managing Director shall, subject to the second proviso, have a minimum term of three years from the date of appointment.
- Remuneration and other amenities.- [Section 5(1)] - (1) If a Government Officer is appointed as whole-time Chairman, he shall be entitled to a special pay of three hundred rupees a month in addition to his own scale of pay and usual allowances admissible to him as a Government Officer. If a Government officer is appointed as part-time Chairman in addition to his own duties, he shall be entitled to a fee of three hundred rupees per month from the Board.
(2) If a non-official is appointed as whole-time Chairman, he shall get gross salary of one thousand five hundred rupees per month or honorarium at a rate agreed to him subject to a maximum of one thousand five hundred rupees per mensem :
Provided that in case the Chairman works in an honorary capacity, he shall be provided with free furnished accommodation at a cost not exceeding [one thousand eight hundred rupees] per mensem.
(3) The Managing Director shall be entitled to a special pay of three hundred rupees per month in addition to his own scale of pay plus usual allowances.
(4) An Associate Director and an ex-officio Director shall be paid a fee of one hundred rupees per meeting in addition to the travelling allowance for journey from the place of his ordinary residence to the head-quarters of the Board or any other place when a meeting is held and back, for the purpose of attending the meeting of the Board.
Note. - A Government Officer holding a substantive appointment at the time of his appointment as a whole-time Director shall be allowed regular increments as and when these would have accrued to him had he not been appointed as a director. If the post under Government was held in an officiating capacity, the Officer appointed as director shall be entitled to the benefit of the monthly emoluments and increments relating to such officiating appointments only so long and upto the date it is certified by the government that the officer would have continued to officiate in the said post or in another post carrying the same or higher emoluments but for his appointment to the Board.
- Travelling allowance.- [Section 5(1)]. - (1) The directors shall, for journey performed for the purpose of the Board, be entitled to the travelling allowances at the rate for the time being admissible under the Punjab Civil Services Rules to the Officers drawing pay at the rate of [two thousand rupees to two thousand and five hundred rupees]per mensem :
Provided that a person who is a member of the State Legislature or Parliament and is appointed as a director shall be granted travelling allowance in accordance with the rules regulating the grant of travelling allowance to the members of the Punjab Vidhan Sabha or members of the Parliament, as the case may be;
Provided further that in the case of non-official Chairman he shall be paid at the rate admissible at the maximum scale of post of Managing Director.
(2) No journey outside the jurisdiction of the Board shall be undertaken by the Chairman without the prior approval of the Board and the Chairman shall be competent to allow the other directors to undertake journey for the performance of the duties of the Board.
- Medical and accommodation facilities.- [Section 5(1)] - The whole-time directors shall be entitled to such medical facilities and accommodation facilities as are admissible to Class I Officers of[Government]:
Provided that in case of non-official Chairman who is not working in an honorary capacity, he shall be entitled to a house rent allowance not exceeding nine hundred rupees per month and for medical facilities he shall be governed by the Rules of the Board when framed; and till such rules are framed he shall be governed under the Punjab State (Medical Attendance) Rules, 1949.
- Leave.- (1) The whole-time directors, who are Government Officers shall be entitled to such kind of leave including casual leave as may be admissible under the service rules applicable to them as Government Officers. The non-official directors shall be given such leave as is admissible to Class I Officer of the Government under the Punjab Civil Services Rules.
(2) The power to sanction casual leave to the Chairman shall vest in the Government and power to sanction such leave to the other whole-time directors shall vest in the Chairman.
(3) The power to grant leave, other than casual leave, to the whole-time directors shall vest in the Government.
(4) The part-time directors shall not be entitled to any leave but leave of absence from the meeting of the Board may be granted to them by the Chairman:
Provided that if a part-time director is absent from three or more consecutive meetings, the matter shall be referred to the Government for taking action under Section 7 of the Act.
- Filling of vacancy.- [Section 5(1)] - Whenever a vacancy of a director or an associate director arises, the Chairman shall report the matter to the Government or place it before the Board, as the case may be, for filling that vacancy.
- Ban on acceptance of other assignment.- [Section (5)] - The whole-time directors of the Board shall not accept any assignment other than that of the Board, without the prior permission of the Government.
