G.S.R. 71, dated 4th November, 1980. - In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and in exercise of all other powers conferred in this regard, the Governor of Bihar is pleased to make the following rules for the regulation of recruitment and promotion to the technical posts of Directorate of Archaeology and Museums, Bihar under the Education Department, namely:-

Part I

  1. Short title and commencement.- (1) These rules may be called the Bihar Directorate of Archeaology and Museums Ex-cadre Technical Service Recruitment and Promotion Rules 1980.

(2) It shall come into force at once.

  1. Objective and extent.- (1) Since for the persons appointed against the ex-cadre technical posts of the Directorate, mentioned in Appendices 'A' and 'B', there is no provision for promotion to higher posts, these rules have been framed in order to provide appointment and promotion to aforesaid technical personnel possessing qualifications fixed for direct recruitment for the higher posts.

(2) These rules shall apply to appointment and promotion of the non-gazetted ex-cadre class III technical personnel working in all offices under the control of the Directorate of Archaeology and Museums, Bihar.

  1. Definitions.- In these rules, unless there is anything repugnant in the subject or context:-

(a) "Directorate" means the Directorate of Archaeology and Museums, Bihar, under the administrative control of the Education Department, Government of Bihar;

(b) "Head of the Department" means the Director, Archaeology and Museums, Bihar, Patna;

(c) "Government" means the Government of Bihar;

(d) "Governor" means the Governor of Bihar;

(e) "Scheduled Castes" means the castes specified in Part II of the Constitution (Scheduled Castes) Order, 1950 and similar orders made from time to time in modification thereof;

(f) "Scheduled Tribes" means the tribes specified in Part II of the Constitution (Scheduled Tribes) Order, 1950 and similar orders made from time to time in modification thereof by the State Government.

  1. Source of Recruitment.- (1) Of the non-gazetted ex-cadre technical posts mentioned in Appendix 'A', those of Draftsman-cum-Surveyor, Surveyor-cum-Draftsman, Photographer-cum-Draftsman or Photographer and Estimator-cum-Draftsman are the junior-most posts in rank, pay-scale and status. All these posts are of equal rank.

(2) The Head of the Department shall constitute a Selection Committee as per the latest circular issued by the Appointment Department in this behalf, namely, No. 1918, dated 28th January, 1976. If there be any modification in future in the procedure by the Department of Personnel and Administrative Reforms, then the modified procedure will be applicable here also.

  1. Procedure of Appointment/Promotion.- For the purpose of promotion from Group I of either Appendix 'A' or 'B' to Group II of either Appendix 'A' or 'B' and on posts of equal nature to be created in future the following procedure shall be followed:-

(1) 50 per cent of the vacant posts may normally be filled through direct recruitment.

(2) 50 per cent of the vacant posts shall be filled up through promotion of the ex-cadre technical staff from lower rank possessing the necessary qualification:

Provided that if suitable departmental candidates beyond 50 per cent promotional quota are available, the promotional quota may be increased after obtaining prior specific orders from the Government in this behalf.

(3) On promotion to a higher post, the pay will be fixed on the basis of the pay fixation rules as laid down in Jharkhand Service Code, 2001. The promotees shall be considered senior to the outsiders appointed at the same time through direct recruitment.

  1. The Appointing Authority shall have right to reject the claim for promotion of the candidate in case of his unsuitability due to misbehaviour and adverse remarks, notwithstanding the fact that he fulfils all the requisite qualifications.

M.A. in Oriental language and B.A. in Indian History.
2. Exploration and Excavation Officer Rs. *510-1,155 Second Class M.A. in Ancient Indian History and Culture/ Archaeology/ Asian Studies/ Art and Architecture/ History with Ancient Indian History and Archaeology, Art and Architecture and sufficient experience of working in excavations conservation or museums.
