Bihar Development of Homeopathic System of Medicine (Payment of Allowances) Rules, 1982

S.O. 973, dated the 19th June, 1982. - In exercise of the powers conferred by clause (d) of sub-section (2) of Section 53 and Section 12 of the Bihar Development of Homeopathic System of Medicine Act, 1953, (Bihar Act XXIV of 1953) the Governor of Bihar in pleased to make the following rules, namely:-

  1. These Rules may be called the "[Bihar Development of Homeopathic System of Medicine (Payment of Allowances) Rules, 1982]".
  2. The President of the Homeopathic Board shall be entitled to the following facilities:-

(a) The President shall be provided with a Personal Assistant or a Stenographer Class I or a Steno Typist and two orderly peons.

(b) The President shall be provided with a rent free quarter and in case of non-availability of quarters, a house on hire shall be made available to him provided the rate of house rent does not exceed Rs. 500 (Five Hundred) per month. But in case a house on hire is not available within the prescribed limit of house rent, in that case, the Board in special case shall refer the aforesaid limit of house rent for the previous approval of the State Government.

(c) The President shall be paid Rs. 30 (Thirty) as honorarium on each day he attends the office of the Board in connection with the Board's work. But in case the President is a member of the Assembly or Council and for the days he has been paid daily allowance from the House as a member of the House, he shall not be paid honorarium for these days from the Board.

(d) The President shall be paid travelling and daily allowance equivalent to admissible travelling and daily allowance of the highest officer of the State Government for the journey within the State. But for the journey outside the State, the President shall be entitled to if available Government rest house, etc., daily allowance prescribed for highest officer of the Government of India. But for the expensive cities such as Calcutta, Bombay where no Government rest-house is available and a accommodation has to be made in a hotel, in that case daily allowance at a maximum rate of Rs. 50 (Rs. Fifty) per day prescribed for the highest officer of Government of India for accommodation in those places shall be paid to him.

(e) The President shall be paid conveyance allowance at the maximum rate of Rs. 200 (two hundred) per month for the journey performed by his own car within a radius of 8 k.m. from the headquarter in connection with the Board's work. But if he uses the Board's staff car for the same he shall have to pay the charge thereof himself.

(f) The Hon'ble President shall be paid mileage allowance at the rate of mileage charge admissible to Class I Officers of the State Government if he undertakes the journey beyond the radius of 8 k.m. in connection with Board's work by his own car. But if he undertakes the journey by the Board s car, in that case he shall not be entitled to any mileage allowance.

(g) The President shall be provided with the telephone facilities at residence as well as in office.

(h) The President shall be entitled to medical facilities at par with the medical facilities admissible Bihar Registration of Homeopaths (Maintenance of Registers) Rules, 1955

  1. Short title and commencement.- (1) These Rules may be called the "Bihar Registration of Homeopaths (Maintenance of Registers) Rules 1995".

(2) They shall come into force at once.

  1. Definitions.- In these rules, unless there is anything repugnant in the subject or context,-

(a) "The Act" means the Bihar Development of Homeopathic System of Medicine Act, 1953;

(b) "Form" means a form set out in the Schedule appended to these rules;

(c) "Section" means a Section of the Act.

  1. The Register of Homeopathic Practitioners required to be maintained under Section 21 shall be in Form 'A'.
  2. The names of all persons registered under the Act shall be entered in the register together with all relevant particulars required under the preceding rule.
  3. (a) All application for registration shall be made in Form 'B' of the Schedule obtained from the office of Registrar with a fee of twenty five rupees and a stamp duty of [Rs. twenty five]in adhesive stamps to be affixed to the registration certificate leviable under Article 24 of Schedule 1 to the Indian Stamp Act, 1894.

(b) An application for renewal of certificate of registration shall be made in Form 'E' and thereupon such certificate of registration shall be renewed and a certificate in support of such renewal shall be given in Form 'F'.

(c) In the event of registration being refused to any application, the ground for such refusal shall be recorded in detail and the same communicated to him and the registration fee of rupees twenty five shall, after deducting the money order commission, be refunded to the applicant by postal money order.

  1. Each page of the register shall be verified and signed by the Registrar.
  2. The memorandum of an appeal by a person aggrieved by the decision of the Registrar, registration of any person or the making of any entry in the register, shall state the grounds on which the registration or entry is claimed and shall be presented to the President of the Board personally or sent to him by registered post. On receipt of the memorandum, the President shall fix a date for the hearing of the appeal and cause copies of the memorandum to be distributed to all the members of Board notice of the date so fixed shall be served on the appellant directing him to appear before the Board either personally or through his duly authorised agent or lawyer with evidence, if any, in support of the appeal. The Board shall on the date fixed, or any other date to which the hearing may be adjourned, hear the appellant or his agent and the Registrar and decide the appeal.
  3. Every person, whose name has been entered in the register shall be entitled to receive from the Registrar a certificate of registration. Such certificate shall contain the full name of the person registered, his designation and address and the date and place of registration. Such certificate shall be in Form 'C'.
  4. On application for a duplicate certificate, a certificate in Form "D1" may be issued.
  5. The Registrar shall re-enter in the register, if it deems fit, the name of any person which may have been removed therefrom under Section 24 of the Act, but no application for the restoration to the register of the name of a person which has been so removed shall be entertained, unless it is accompanied by a declaration made by the applicant setting forth the facts of the case, and stating that he is the person originally registered, and unless it is accompanied also by a certificate as to his identity from two practitioners registered under the Act or, in the case of an applicant residing abroad, a certificate as to his identity signed by two persons, who shall be Magistrate or officers of a gazetted rank serving in the Civil or Defence Services of Government or two resident practitioners registered under the Act. A fee of ten rupees shall be levied for the registration of a practitioner whose name has been removed from the register under Section 24.
