Bengal Cruelty to Animals (Arrest) Act, 1869

An Act to enable Police-Officers to arrest without warrant person guilty of cruelty to Animals

Preamble. - Whereas it is expedient to enable police-officers in certain places to arrest without warrant any person committing, within their view, any offence against Act 1 of 1869 passed by the Lieutenant-Governor of Bengal-in-Council, entitled an Act for the Prevention of Cruelty to Animal;

It is enacted as follows;-

  1. Power to arrest without warrant persons guilty of cruelty.- Every Police-Officer may arrest without a warrant any person committing, in his view; any offence against the said Act 1 of 1869.
  2. Act to apply to Calcutta and suburbs.- This Act shall apply to the Town of Calcutta, as defined in Act 4 of 1866 passed by Lieutenent-Governor of Bengal-in-Council and in the suburbs of the town of Calcutta, as the same may from time to time be defined by any notification to be from time to time published by the said Lieutenant-Governor in pursuance of the provisions of Act 2 of 1866, and save as hereinafter is provided, to such towns and suburbs only.
  3. Power to extend Act.- It shall be lawful for the [State]Government of Bengal, by a notification, to be published in the [Official Gazette], to extend this Act to any town, suburb, district or tract of country, to be mentioned and defined in such notification; and from and after the publication of such notification this Act shall extend and apply to the town, suburb, district or tract of country therein mentioned and defined.
