Assam Excluded Areas (Post Office) Regulation, 1941

[Received the assent of the Governor-General on the 22nd September, 1941].

Preamble. - Whereas it is expedient to amend the Indian Post Office Act, 1898 (6 of 1898), hereinafter referred to as the said Act, in the application to the excluded areas in Assam specified in the Schedule to the Government of India (Excluded and Partially Excluded Areas) Order, 1936; and whereas by subsection (2) of Section 92 of the Government of India Act, 1935 the Governor is empowered to make regulations for the peace and good Government of any area in his Province which is for the time being an excluded area;

Now, therefore, the Governor of Assam in exercise of the said power and of all other powers enabling him in that behalf, is pleased to make the following Regulation for the said excluded areas.

  1. Short title.- (a) This Regulation may be called the Assam Excluded Areas (Post Office) Regulation, 1941 (2 of 1941).

(b) Local extent. - It extends to the District of Tuensang in the State of Nagaland.

(c) Commencement. - It shall come into force on such date as the Governor may by notification in the official Gazette appoint.

  1. (1) The proviso to sub-section (1) of Section 7 and the First Schedule of the said Act shall be omitted.

(2) For sub-section (2) of Section 7 of the said Act, the following shall be substituted namely:

"(2) Unless and until such notification as aforesaid is issued the rates chargeable for the time being in the rest of British India shall be the rates chargeable in Sadiya/Balipara/Lakhimpur Frontier Tract, the Naga Hills, the Lushai Hills and the North Cachar Hills.

No. 6249-G.S. - In exercise of the powers conferred by Section 1 (c) of the Assam Excluded Areas (Post Office) Regulation of 1941 (Regulation 2 of 1941), His Excellency the Governor of Assam is pleased to appoint the 1st October, 1941 as the date on which the said Regulation shall come into force.
