जो प्रतिफल धन के रूप में नहीं है, उसका भागतः निष्फल होना -- ज, कि उस प्रतिफल का, जिसके लिए, किसी व्यक्ति ने वचन-पत्र, विनिमय-पत्र या चेक हस्ताक्षरित किया था, कोई भारी यद्यपि धन के रूप में नहीं है, तथापि सम्पार्शिवक, जांच के बिना धन के रूप में अभिनश्चित किया जा सकता है और उस भाग की निष्फलता हुई है वहाँ वह राशि, जो उसहस्ताक्षरकर्ता से अव्यवहित सम्बन्ध में स्थित धारक उससे वसूल करने का हकदार है, अनुपाततः कम हो जाती है ।
