‘Universities must not suppress Peaceful Expression’: HC quashes Student Expulsion

The Delhi High Court has set aside the expulsion of a University Student accused of participating in a campus protest, holding the punishment to be excessive and legally unsustainable. The ruling reinforces the protection of peaceful dissent within educational institutions and limits the extent to which universities can penalise student expression.

The case arose after a student, who had earlier raised complaints of ragging and harassment, was suspended and later expelled for allegedly joining a sit-in protest in violation of prior court directions. The university relied on disciplinary rules and claimed breach of an earlier undertaking, while the student denied active participation, asserting she was merely present at the protest site.

The dispute centred on whether such presence amounted to misconduct warranting expulsion and whether institutional discipline could override constitutional guarantees of free speech and assembly.

The Court emphasised that universities serve as spaces for intellectual exchange and cannot stifle non-violent dissent. It held that even if the student had participated in a peaceful protest, the penalty imposed was excessive and unjustified. “Expulsion of the petitioner from university for participation in a peaceful protest is a highly disproportionate disciplinary action,” the Court observed, adding that enforcement of alleged breach of a court order lies within judicial domain, not institutional authority.

Consequently, the impugned orders were quashed, and the student was allowed to resume studies from the third semester, with the lost academic year treated as sufficient penalty.
