The National Green Tribunal has taken suo motu cognizance of the death of a software engineer who drowned after falling into a waterlogged trench at a commercial site in Noida, holding that administrative failures in preventing prolonged waterlogging raise serious environmental law concerns under the Environment (Protection) Act, 1986.
The action stems from a fatal incident in Sector 150, Noida, where a software professional lost his life after slipping into a water-filled trench at a site originally earmarked for commercial development but left neglected for years. Reports placed before the Tribunal indicated that the land had effectively turned into a stagnant water body due to unchecked accumulation of rainwater and wastewater from nearby residential complexes.
Despite repeated surveys and a storm water management plan prepared as early as 2015, critical remedial infrastructure, meant to divert excess water into the Hindon river, was never executed, even after funds were released for preliminary work, resulting in persistent waterlogging and hazardous conditions.
The Bench, led by the NGT Chairperson along with an expert member, noted that the material on record pointed to clear institutional lapses, observing that “the news item indicates lapse by the Noida Authority in taking up remedial measures which resulted in the death of the person.” The Tribunal held that the incident prima facie disclosed violations of environmental norms and statutory obligations under the Environment (Protection) Act, warranting regulatory scrutiny.
Exercising its recognised power to act on its own motion, the Tribunal registered an original application, impleaded key state and local authorities as respondents, and directed them to file sworn replies ahead of the next hearing.
