High Court granted ad-interim Relief to Hindustan Unilever Limited (HUL) over the Trademark issue between the HUL and the Emami [Read Order]

On 6 July 2020, the Bombay High Court ordered the Emami  Limited to issue a notice to the Hindustan  Unilever Limited (HUL) over the trademark for ‘Glow and Lovely ‘and ‘Glow and handsome', before it could take any legal action.

The Hindustan Unilever Limited has decided to re-brand the two beauty products namely Fair and Lovely (for women)  and Men’s Fair and Lovely to “ Glow and Lovely “and “Glow and Handsome “.

The HUL filed a plea contending that it had already given application for the trademark of Glow and Lovely and Glow and Handsome in September 2018.

It has been argued that Emami is not entitled to the trademark as it has not used it and shall not adopt the same as the HUL had already adopted the trademark.

Justice B. P. Colabawalla observed that the trademark application given by HUL in 2018 clearly shows that the HUL has the right over the trademark. It has also been found that Emami has adopted the ‘ Glow and Handsome ‘ trademark from June 25, 2020, but it had not used it commercially. In view of this, the Court granted ad-interim relief to HUL.

The Court is of the view that ‘ the statements made by the defendant (Emami) and published in various newspapers annexed to the plaint to do amount to a threat ‘ and this issue will be decided on July 27, 2020.
