CLAT 2020: Petition filed in Supreme Court for quashing of entrance exam due to tech glitches, seeks direction for re-conducting the exam [Read Petition]

On Saturday, a petition has been filed by a group of aspiring law students before the Supreme Court seeking the quashing of the exam held on September 28.

The petition submits that the conduction of the Common Law Admission Test (CLAT)  is erroneous, faulty, defective & discriminatory and, violative of Article 14 & 15. And prayed to quash the exam and for a direction to the National Law School Consortium to re-conduct the exam.

The petition highlights the grievances faced by the aspirants due to technical glitches during the CLAT 2020. It even prayed before the court to set up a high-powered committee to look into the complaints lodged and grievances raised by the students.

 As per the Petition 'CLAT 2020‟ in peculiar circumstances wherein results declared by the Consortium of NLU, are totally wrong, incorrect, erroneous, and therefore, biased due to the following reasons:-

1. The candidates have chosen/selected/ticked correct answers; however, it is reflecting in a result that us wrong and/or different options have been chosen/selected/ticked.

2. The result is displaying and calculating marks in those questions, which were not even attempted by the candidates.

3. Candidates have chosen/selected/ticked different options; however, in the results, different answers are shown as chosen/selected/ticked.

4. 10 questions are either wrong themselves, or their answers which are uploaded on the website are wrong.

“Many questions in CLAT 2020 were such that all four options provided in the question were wrong. By way of illustration, some such questions in the mathematics section were question numbers 146, 147. 148, 149, and 150. (Though later on, few questions are dropped by respondent no. 1). Similarly, the answer key provides wrong answers for several questions including question numbers 5, 6, 8, 14, 16,19, 35, 45, 103, 122, and 125 which are from the English, Logical Reasoning, and Legal Reasoning sections. Many of these questions also had more than one right answer, from among which it was not reasonably possible to choose the “most appropriate” option.”

The petition claims was an "arrogant" move by the Consortium. The petition says,

"...neither grievance committee nor the consortium looked into the issues of objections/grievances filed by the petitioners/aspirants in large numbers, however, dealt the same with the biased approach in very arrogant way vide their press release dated 03.10.2020."

It is also submitted that the Consortium of National Law University issued a press release on 3rd October 2020 in a very arrogant way, stating therein that a large number of objections are filed because CLAT-2020 had made filing of objections absolutely free, however, other institutions charge Rs. 1,000/- per objection.

The CLAT Is due to release final score lists by today (Monday 5th October), with admissions due to start by mid-October.
