In the wake of the recent encounter of UP gangster Vikas Dubey, Lawrence Bishnoi, currently in Bharatpur Jail, another gangster has moved to the court with the apprehension that the same might happen to him. There have been several opinions regarding the encounter of Vikas Dubey, some criticized the move of the police saying that 'extra-judicial killing' must not be promoted and there has been a dearth of Principles of Natural Justice, Others felt that keeping this gangster in the clutches of the judicial system can lead to prolonged trials and he might use his political contacts to go scot-free. Some belief it to be a prior conspiracy while some say that criminals committing such barbaric acts of murder must be dealt this way. The reality can only be disclosed after a proper investigation, however, since then certain developments regarding Bishnoi, the aforementioned criminal, have taken place that is worth our attention.
Bishnoi's lawyer claimed that it has been two years since Bishnoi has had any contact with the outside world, yet his name has appeared in news for two firing cases. He claimed that there has been a conspiracy against Bishnoi and he is falsely being accused of the crimes since he has already been convicted in many cases. His involvement in any case, the counsel said, is falsely implicated by the police to keep him in jail. It was not the first time he is being falsely accused of anything. Thus, he filed a petition asking to be 'handcuffed' when brought to court or taken anywhere else and also asked for special security so that he is not killed in police custody. Finally, he has also filed for anticipatory bail under Section 438 of The code of Criminal Procedure that says, "When any person has reason to believe that he may be arrested on an accusation of having committed a non- bailable offense, he may apply to the High Court or the Court of Session for a direction under this section; and that Court may if it thinks fit, direct that in the event of such arrest, he shall be released on bail."
The court has sought a reply from Chandigarh police by July 13, 2020 regarding the same.
