Special Court directs CBI to probe alleged Disproportionate Assets of Ex-Chief of RAW

Special CBI Court in Delhi has issued directions to inquire into complaint of amassing of disproportionate assets by a former secretary of the Research and Analysis Wing, country's elite Intelligence Agency.

In a similar fashion when an earlier order was passed by a Special CBI court on February 18, 2013 asking Central Bureau of Investigation (CBI) to probe the assets of AK Verma, the then Chief RAW, it was challenged by CBI before the Delhi High Court and was ultimately quashed.

Court had examined witnesses on record and collected various documents movable/immovable assets of the accused. But no concrete evidence was found in respect of a large number of reported assets, allegedly acquired by the accused while he was Chief of RAW.

The Court pointed out that in the present case the accused persons are the residents of Noida,UP which is beyond the territorial jurisdiction of the courts in Delhi.

Judge refereed to incomplete evidence which has come on record, in the pre summoning evidence of the complainant.

Relying on a Supreme Court Judgment, the Court directed CBI Director to conduct  an investigation in the form of an inquiry by an officer not below the rank of Superintendent of Police regarding the all the income and assets of the accused persons under Section 202 of CrPC and submit report to the Court within three months.
