The Madras HC has directed the authorities concerned to consider a representation moved by a non-judicial member of the Tamil Nadu State Consumer Dispute Redressal Commission (TNSCDRC) seeking payment of revised salary as per the Consumer Protection (Appointment, Salary, Allowances & Conditions of service of President & Members of the State Commission & District Forum) Rules, 2018 & to disburse the same along with all allowances & arrears. Justice M S Ramesh passed the order on a plea moved by S M Murugeshan who was appointed as permanent whole time non-judicial member of Tamil Nadu State Consumer Dispute Redressal Commission (TNSCDRC) in the circuit bench inside Madurai district court premises. The judge also made it clear that the court hasn't expressed any of its view with regard to the claim made by the petitioner & it is for the authorities to consider it in accordance with law.
The judge observed that the petitioner had stated that he had already made a representation to the authorities concerned on Nov 22, 2019 which was said to be kept pending. The judge noted that if the said representation is directed to be disposed of within a stipulated time, the ends of justice could be secured. “Whenever a representation is made to a statutory authority to redress the claim of the employee, there is a duty cast upon the authorities to consider the same on its own merits & pass appropriate orders in one way or other, instead of keeping the same pending indefinitely. Any inaction would amount to dereliction of duties.”
