Judicial Appointments: Will SC agree with Govt on National Security Clause in the MoP?

February,28,2017:The stalemate is long continuing between the two.

Supreme Court collegium is likely to come around to accept Centre's stance that it can turn down the names of judges recommended for appointment to High Courts and Supreme Court on the grounds of national security on condition that reasons are recorded in writing.

The collegium will soon convey to government its new stand, in what can clear way for early appointment of the judges of High Courts and Supreme Court. MoP might be finalised by month-end, according the sources.
National Security clause has been one of trickiest in Memorandum of Procedure (MoP) for appointment of the judges which has been hanging fire since December 2015, when a five-judge constitution bench entrusted its redrafting to the Centre in consultation with the CJI.
Draft MoP which was prepared by Centre had been tossed to collegium and back without much progress on the `national security' clause for the past year.
