High Court stays Minimum Wage hike on the plea of Traders body

A State Bill proposes a penalty of Rs 50,000 and a jail term up to 3 years for violation of the provisions.

3 days after Delhi Govt. announced revised minimum wages, the HC on Tuesday partially stayed its operation.

A bench comprising of Chief Justice G Rohini & Justice Sangita Dhingra Sehgal directed the govt "not to take any coercive action" in the matter & decided to examine validity of the decision in next week.

On 3rd March, lieutenant governor Anil Baijal approved the govt's decision to hike minimum wages of the unskilled, skilled and semi-skilled workers by around 37%.

The Bill proposes a penalty of ₹50,000 & a jail term up to 3 years for violation of provisions. At present, the penalty is ₹500 while jail term is 6 months.

High Court  acted on an application moved by the Apex Chamber of Commerce & Industry, which is a city based traders body, which had challenged AAP govt's decision last year on the ground that it lacked LG's approval & violated Section 9 of the Minimum Wages Act.

It sought an immediate stay on the govt decision arguing that it involves future of Delhi's industry being put to dark by the attitude of AAP govt. to gain a political mileage at cost of abnormal proposed increase of the wages.

CM Arvind Kejriwal last week said that the hike in wages is "historic" & "highest" in independent India.
