High Court: Prisoner in Jail is a Human being too & his Crime does not reduce him to a non-person

Bench said, the human life of a prisoner is precious and it is of paramount importance that it is preserved.

High Court of Madras has on Monday allowed a murder and detainee under the stringent Goondas Act, to undergo treatment at a private hospital for his heart disease.

Justice S Vimala, observed that a prisoner is a human being too and his crime does not reduce him to a non-person.

Court granted the accused a three days parole on a petition by his wife seeking treatment for him in the private hospital.

The man is lodged in Tiruchirappalli Central Prison,

The High Court Judge suggested that the Legislature shall take steps to codify the rights of prisoners detained in Jails.

The contention of Superintendent of Tiruchirapalli Central Prison that no prisoners can be permitted to take medical treatment at private hospitals was rejected.

The Bench observed that even though Pandidurai, petitioner Sumathi's husband was in Jail under severe charges, the human life of such a prisoner is also precious and it is of paramount importance that it is preserved.

Court allowed the prisoner to have treatment at the hospital in Tiruchirappalli entirely at his own cost.

The plea that other prisoners too would make similar request for treatment and admission in private hospitals & it would cause administrative problems did not find favour with the Bench. But it was clarified that such request could be considered only on the merit of each case and the order cannot be a binding precedent for every case.

Accused had suffered chest pain while he was undergoing treatment at government hospital.

The Government hospitals are flooded with patients and short of manpower and equipment. Hence prayed for treatment at private hospital.
