High Court Acquits man sentenced to death for Triple Murder[Read Judgment]

On Tuesday , 2nd June 2020 the Allahabad High Court acquitted a Man in a Triple Murder Case who was given the death penalty in 2013.

A division bench of Justices R.R. Awasthi and V.K. Srivastava held that the prosecution failed to prove its case beyond a reasonable doubt.

Senior Lawyer Nagendra  Mohan  on behalf of the Appellant Stated that the Entire Case was based on circumstances evidence and there was no direct against his client.

It was argued “that the  informant  filed an F.I.R. 17 Days after the incident, whereas he was  present at the time of inquest and postmortem .”

The bench found out that the F.I.R. was registered 17 days later and the Police of Tanda Kotwali was informed on April 12, 2013, by a relative.

The Police  filed the charge sheet after  recording the statements of the informants and his family members, police were against the Theory of Illicit relationship.

Finally, the Bench concluded that the prosecution’s version was not reliable and it denied confirming the reference sent by the Trial Court to uphold the death penalty.
