Allahabad high court dismissed two petitions against the online broadcasting of two web series “Pataal Lok” and “XXX-Season 2” stating “we are not inclined to interfere in the matter by invoking our extraordinary discretionary powers.”
The writ petition filed against Pataal Lok stated that it sought orders from the court to stop the telecast of the series on the grounds that the petitioner found it to be in violation of their fundamental rights of freedom of religion since the web series was offending the principles of ‘Sanatan Dharma’.
The petition was filed against the web series “XXX Season-2” by the brother-in-law of and Indian soldier who also sought a ban on the airing of the series since it showed scenes tarnishing the reputation or wives of army-officers and was derogatory to their social image.
The divisional bench of Cheif Justice Govind Mathur and Justice Siddhartha Varma dismissed the pleas on the ground that petitioners had to make demands to the competent authorities before moving to the court and said “It is a settled principle of law that the person demanding writ in the nature of mandamus is first required to make a demand from the Authority competent. A deviation from such a settled principle can be made only in extraordinary circumstances and no such circumstance has been pointed out by the petitioner in this petition for the writ. In view of whatever has been stated” the court, however, stated that the petitioners had the liberty to move to competent authorities submitting a representation on notice for the demand for justice.
