The Delhi High Court has limited its functioning pertaining to nationwide lockdown due to the COVID-19 pandemic.
As per its last Notice, the Court has been taking up 'extremely urgent' matters only. Now that the Govt has provided some relaxation to the lockdown, expanding the sphere of functioning is what the HC administration is finding prudent.
Thus the Court has decided to take up the some other categories of pending matters during period of suspended functioning of the Court to the extremely urgent matter categories.
The new categories include:
(i) Matters related to The Protection of Women from Domestic Violence Act 2005
(ii) Matrimonial matters (including the matters relating to maintenance, visitation rights and custody)
(iii) Eviction matters based on bonafide requirement
(iv) All Criminal Appeals/Revisions/Petitions in which convict is in custody
(v) MACT Appeals involving death and permanent disability
(vi) Petitions under sec 9 and sec 34 of Arbitration and Conciliation Act 1996
(vii) Quashing of criminal case based on settlement through Mediation
(viii) Ex parte matters
The Court clarified that matters would be taken up for disposal subject to some conditions. It has also allowed e-filing of ‘non-urgent matters’/routine matters, however hearing of the matters will held when the Court will be back to regular functioning and not during this restricted fuctioning.
