The Supreme Court took up applications filed by three academics earlier barred from participating in public institutional projects over their role in drafting a controversial NCERT Class 8 chapter on judicial corruption, with the scholars now seeking an opportunity to present their case and mitigate the impact of the Court’s adverse observations, an issue that carries significant implications for academic freedom and institutional accountability.
The controversy traces back to a textbook chapter that triggered judicial scrutiny, leading the Court to initiate suo motu proceedings and impose a sweeping restriction on the academics’ future involvement in public academic work. The authors, through senior counsel, argued that the Court’s earlier remarks had caused serious prejudice, prompting them to file personal affidavits explaining the academic and pedagogical context behind the chapter. It was contended that the content formed part of a broader curriculum approach under the National Education Policy, addressing institutional challenges across governance structures, and was not intended to single out the judiciary.
The Union Government, meanwhile, informed the Court that an expert committee comprising eminent legal and academic figures had been constituted to review the revised content, reflecting the broader institutional response to the controversy.
The Bench, while not entering into the merits at this stage, engaged with the submissions and acknowledged the request for a hearing. In a pointed exchange, the Court questioned the intent behind the applications, asking, “Are you defending your actions?”, a remark underscoring the gravity with which it views the issue.
Taking the affidavits on record, the Court directed that the applications be listed for consideration after procedural defects are cured, thereby keeping the matter alive for substantive adjudication.
