Cornellia Chambers is a lawyers’ collective based in Gurugram.Cornellia Chamber is organising a Hackathon for law students to hack an old hack called adjournment.
They are organising this Hackathon to call upon law students to think of legal strategies that can be used to disrupt this old and unethical strategy. In order to help you do this, they are setting out a proposition.
Your submission could be in the form of a strategy note wherein you will identify the core legal issues, provide solutions supported by legal precedents on the same.
There is no strict format for your submission. So, be as creative as you can be! (Hint: a petition/ application might be a good idea).
Zed, an Airforce Officer had filed an RTI application for certain information before the Ministry of Defence. In a second appeal, CIC through a well-reasoned order instructed the Ministry of Defence to provide such information to Zed in August 2016.
Thereafter, the Ministry of Defence filed a Writ Petition before the Delhi High Court praying for a Writ of Mandamus against the order of the CIC. The matter was first heard in August 2016 and the Delhi High Court granted a stay on the CIC order.
The matter has since not been heard because of multiple pass-overs and adjournments. Zed is deeply aggrieved due to this delay in justice.
In view of these facts and circumstances, Cornellia Chambers wants you to find a legal solution to this procedural problem of matters being adjourned (where a stay has been granted).
Based on the best solution that is presented Cornellia Chambers will move the Hon’ble Delhi High to challenge the practice of adjournments in matters where a stay has been granted.
Cornellia Chambers wants that such matters should be mandatorily be heard in a time-bound manner. This will encourage the development of a vibrant and efficient legal ecosystem.
Hint: the solution may lie in some case law – Indian, English or Australian or American.
The best submission will win an amount of Rs. 2500 and a month-long summer internship with Cornellia Chambers.
Further, Cornellia Chambers will give Certificates of Merit to five students.
